Terms and Conditions of Sale

These terms of sale are entered into, on the one hand, by the company Kharaz Jewelry, whose registered office is located at 99 avenue Achille Peretti 92200 Neuilly-sur-Seine, registered with the Nanterre Trade and Companies Register (RCS) under number 850 517 210 00025, hereinafter referred to as "KHARAZ JEWELRY", which operates the website www.kharazjewelry.com, and, on the other hand, by any natural or legal person wishing to make a purchase via the website www.kharazjewelry.com, hereinafter referred to as "the Buyer".

Article 1. Purpose

These terms of sale aim to define the contractual relationship between Kharaz Jewelry and the Buyer, and the conditions applicable to any purchase made through the website www.kharazjewelry.com. The purchase of a product through this website implies the Buyer's unreserved acceptance of these terms of sale, which the Buyer acknowledges having read prior to placing their order. Before any transaction, the Buyer declares, on the one hand, that the purchase of products on the website www.kharazjewelry.com is not directly related to their professional activity and is limited to strictly personal use and, on the other hand, that they have full legal capacity to enter into commitments under these general terms and conditions of sale.

Kharaz Jewelry reserves the right to modify these terms of sale at any time in order to comply with any new regulations or to improve the use of its website. Accordingly, the applicable terms will be those in force on the date the Buyer places the order.

Article 2. Products

The products offered are those displayed on the website www.kharazjewelry.com of Kharaz Jewelry, while stocks last. Kharaz Jewelry reserves the right to change its product range at any time. Each product is presented on the website with a description of its main technical characteristics (capacity, use, composition, etc.). Photographs are as accurate as possible but are in no way binding on the Seller. The products presented on the website www.kharazjewelry.com are offered for sale to all buyers residing in countries that fully authorize the entry of these products into their territory.

Article 3. Prices

The prices shown on the product pages of the online catalog are prices in euros (€).

Item prices are stated in euros excluding tax (VAT not applicable – Article 293 B of the French General Tax Code) and excluding processing and shipping costs.

Kharaz Jewelry reserves the right to change its prices at any time, it being understood, however, that the price shown in the catalog on the day of the order will be the only price applicable to the Buyer. The prices shown do not include delivery charges, which are invoiced in addition to the price of the products purchased, depending on the total amount of the order.

Article 4. Orders and payment terms

Before placing any order, the Buyer must create an account on the website www.kharazjewelry.com. The account creation section is accessible directly from the side menu bar. On each visit, if the Buyer wishes to place an order or view their account (order status, profile, etc.), they must log in using these details. Kharaz Jewelry allows the Buyer to order and pay for products in several steps, with a choice of 2 payment options:

- Payment by bank transfer: the Buyer selects the products they wish to order in the "cart", makes any changes if necessary (quantities, references, etc.), and checks the delivery address or enters a new one. The shipping costs are then calculated and submitted to the Buyer, along with the name of the carrier. Next, the Buyer chooses their preferred payment method: "Payment by bank transfer". Finally, the last step allows the Buyer to check all the information, read and accept these general terms and conditions of sale by ticking the corresponding box, and then invites them to confirm their order by clicking the "Confirm my order" button. This final click constitutes the definitive conclusion of the contract. Upon confirmation, the Buyer receives an order form confirming that their order has been registered. To finalize payment and trigger the processing of the order, the Buyer must contact their bank to transfer the amount of the order to the Kharaz Jewelry bank account, the details of which are provided to the Buyer. Upon receipt of the transfer, the order will be processed and the Buyer will be informed by email. Kharaz Jewelry will ship the products no earlier than 2 business days after receipt of the transfer corresponding to the order, subject to the funds clearing.

- Secure payment by PayPal or bank card (via the PAYPAL system): the Buyer selects the products they wish to order in the "cart", makes any changes if necessary (quantities, references, etc.), and checks the delivery address or enters a new one. The shipping costs are then calculated and submitted to the Buyer, along with the name of the carrier. Next, the Buyer chooses their preferred payment method: "Payment by PayPal". The next step allows the Buyer to check all the information, read and accept these general terms and conditions of sale by ticking the corresponding box, and then invites them to confirm their order by clicking the "Confirm my order" button. Finally, the Buyer is redirected to the secure PAYPAL interface to enter their PayPal account details or personal bank card details in complete security. If the payment is accepted, the order is registered and the contract is definitively formed. Payment by PayPal account or bank card is irrevocable. In the event of fraudulent use of the card, the Buyer may demand the cancellation of the card payment; the sums paid will then be re-credited or refunded. The cardholder is not liable if the disputed payment is proven to have been made fraudulently, remotely, without physical use of the card. To obtain a refund of the fraudulent debit and of any bank charges the transaction may have incurred, the cardholder must dispute the debit in writing with their bank within 70 days of the transaction, or 120 days if the contract with the bank so provides. The amounts debited are refunded by the bank within a maximum of one month after receipt of the cardholder's written dispute. No refund charges may be borne by the cardholder.

Confirmation of an order entails acceptance of these terms of sale, acknowledgment of full knowledge of them, and waiver of the right to rely on the Buyer's own terms of purchase. All data provided and the recorded confirmation shall constitute proof of the transaction. If the Buyer has an email address and has entered it on the order form, Kharaz Jewelry will send them email confirmation that their order has been registered.

Article 5. Retention of title

Kharaz Jewelry retains full ownership of the products sold until the price has been paid in full, including principal, fees, and taxes.

Article 6. Withdrawal

In accordance with the provisions of Article L.121-21 of the French Consumer Code, you have a withdrawal period of 14 days from receipt of your items to exercise your right of withdrawal, without having to give reasons or pay any penalty.

Items must be returned in their original condition and complete (packaging, accessories, instructions). In this context, you are responsible for the items. Any damage to the product on this occasion may invalidate the right of withdrawal.

Return costs are at your expense.

If the right of withdrawal is exercised, Kharaz Jewelry will refund the sums paid within 14 days of notification of your request.

Any return request must first be made by email to Kharaz Jewelry.

Article 7. Delivery

Deliveries are made to the address indicated on the order form, which can only be within the agreed geographical area. Orders are shipped by La Poste via COLISSIMO, a tracked delivery service, delivered without signature. Delivery times are given for information only; if they exceed thirty days from the order, the sales contract may be terminated and the Buyer refunded. Kharaz Jewelry may provide the Buyer by email with the tracking number of their parcel. The Buyer's order is delivered to their home by their postal carrier. If the Buyer is absent, they will receive a delivery notice from their postal carrier, allowing them to collect the ordered products from the nearest post office within the period specified by the postal services. Transport risks are borne by the purchaser from the moment the items leave the premises of Kharaz Jewelry. Upon delivery, the Buyer must check the condition of the packaging of the goods and their contents in the presence of the La Poste employee or delivery person. In the event of damage during transport, any complaint must be made to the carrier within three days of delivery.

Article 8. Warranty

All products supplied by Kharaz Jewelry benefit from the legal warranty provided for by Articles 1641 et seq. of the French Civil Code. In the event of non-conformity of a product sold, it may be returned to Kharaz Jewelry, which will take it back, exchange it, or refund it. All claims, exchange or refund requests must be made electronically to the following address: contact@kharazjewelry.com, within thirty days of delivery.

Article 9. Liability

In the distance selling process, Kharaz Jewelry is bound only by an obligation of means. It cannot be held liable for any damage resulting from the use of the Internet, such as data loss, intrusion, viruses, service interruption, or other unintentional problems.

Article 10. Intellectual property

All elements of the website www.kharazjewelry.com are and remain the exclusive intellectual property of Kharaz Jewelry. No one is authorized to reproduce, exploit, or use in any capacity whatsoever, even partially, any elements of the website, whether in the form of photos, logos, visuals, or text.

Article 11. Personal data

Kharaz Jewelry undertakes to preserve the confidentiality of the information provided by the Buyer, which the Buyer may be required to provide in order to use certain services. All information concerning the Buyer is subject to the provisions of French Law No. 78-17 of January 6, 1978. As such, the user has the right to access, modify, and delete information concerning them. Article 12. Dispute resolution

These distance selling terms are governed by French law. For any disputes or litigation, the French courts shall have sole jurisdiction.

Article 13 – Archiving and proof

Kharaz Jewelry will archive order forms and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of Article 1348 of the French Civil Code.

The computerized records of Kharaz Jewelry will be considered by all parties concerned as proof of the communications, orders, payments, and transactions between the parties.
